What to Do After a Car Accident

A Step-by-Step Guide from a Personal Injury Attorney

Car accidents happen in an instant. Whether it’s a minor fender-bender or a serious collision, knowing what to do in the moments and days after an accident can protect your health, your legal rights, and your financial future.

As a personal injury attorney who’s helped countless accident victims, here’s what I recommend you do immediately following a crash:

1. Prioritize Safety

  • Check yourself and others for injuries.

  • If the vehicles can be safely moved, pull over to a secure area to avoid further danger.

2. Call 911

  • Even if the accident seems minor, always call the police. An official police report can be a crucial piece of evidence if you need to file an insurance claim or pursue legal action later.

3. Exchange Information

  • Collect and exchange the following with the other driver(s):

    • Name and contact information

    • Take photos of their driver’s license, insurance card, license plate and vehicle. . Driver’s license number

    • If there are any witnesses, get their name and contact information.

4. Document the Accident

  • Documentation can be critical in proving what actually happened. If it is safe to take pictures before moving the vehicles, it is a good idea to take photos of where the vehicles are.

  • Use your phone to take clear photos of:

    • All vehicles involved (from multiple angles), damage to any vehicle involved

    • Road conditions, skid marks, traffic signs, debris

    • Any visible injuries

5. Seek Medical Attention

  • Even if you feel “fine,” it’s essential to get checked out. Some injuries (like whiplash, concussions, or internal trauma) may not show symptoms right away. Prompt medical care creates a record that links your injuries to the accident.

  • Do not be surprised if you feel worse in the days following the accident, this is common. It is important to seek medical attention if you are in pain.

6. Contact a Personal Injury Attorney

  • Before signing anything or accepting a settlement offer, talk to an experienced attorney. You don’t pay us unless we win—and consultations are always free.

  • Shane Hickey helps accident victims:

    • Build a strong case from the start

OTHER IMPORTANT CONSIDERATIONS:

I would highly suggest to talk to an attorney before speaking with the other driver’s insurance company. They may want you to make a recorded statement, which can be used against you in the future. Additionally, you may want to notify your insurance company of the accident, it is a good idea to report the accident and give them the facts. They may want you to make a recorded statement, you are not required to give a recorded statement and I would speak to an attorney before you do so.
